Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Triple Dynamic Solutions LLC, an Illinois limited liability company ("we", "our", or "us"), governing your use of the CardAgain mobile application and cardagain.me (together, the "Service").

By downloading, installing or using the Service you accept these Terms. If you do not accept them, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service, or at least 16 if you are in the European Economic Area or the United Kingdom. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms. By using the Service you represent that you meet these requirements.

3. The Service

CardAgain lets you photograph, store and organise greeting cards and other keepsakes; add notes, dates, senders and occasions; attach photos, videos and voice recordings; generate spoken readings of card messages using AI voices; import calendar events; set reminders; and share cards with others.

We may add, change or remove features. If we discontinue a material feature you have paid for, Section 6 explains what happens.

4. Your Account

You create an account using Google or Apple authentication. You are responsible for keeping access to that account secure and for everything done through it. Tell us promptly if you believe your account has been compromised. One person, one account — do not share your account or let anyone else use it.

5. Plans and Storage Limits

• Basic (free) — store up to 10 cards.
• Dreamer — store up to 30 cards, with additional features.
• Lover — store up to 500 cards, with all features.

Current pricing for each plan is shown in the app before you purchase. If you exceed a limit after downgrading or after a subscription lapses, your existing cards remain readable but you will not be able to add new ones until you are back within the limit.

6. Subscriptions, Billing and Cancellation

Paid plans are sold as auto-renewing subscriptions through the Apple App Store.

• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• Your Apple ID is charged for renewal within 24 hours before the current period ends, at the then-current price.
• Manage or cancel your subscription in the Settings app under your Apple ID → Subscriptions. Deleting the app does not cancel a subscription, and neither does deleting your CardAgain account.
• Refunds are handled by Apple under its own policies; we cannot issue refunds for App Store purchases. Contact Apple Support to request one.
• If we increase the price of a plan you hold, Apple will ask for your consent before the higher price applies.

If we permanently discontinue a paid feature during a period you have already paid for, you may request a pro-rata refund from Apple and we will support that request.

7. Your Content

You keep ownership of everything you create or upload — card images, messages, notes, photographs, videos and voice recordings ("Your Content").

You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit and display Your Content, solely to operate the Service for you and for the people you share cards with. This licence exists only so that we can run the app; it ends when you delete the content or your account, subject to the backup window in our Privacy Policy. We do not use Your Content to train AI models, and we do not use it for advertising.

You are responsible for Your Content, and you represent that you have the rights necessary to upload it and to share it with the people you send it to.

8. Voice Cloning — Your Responsibilities

Voice cloning creates a biometric identifier. It carries real legal obligations, and by using the feature you take them on.

• You may clone your own voice freely.
• To clone anyone else’s voice, you must first obtain that person’s informed, written consent to the recording of their voice, the creation of a voiceprint from it, and its storage and use in the Service. If they are a minor, you must be their parent or legal guardian, or hold that person’s consent.
• You must not use the feature to impersonate anyone, to deceive, to create the impression that a person said something they did not say, to produce content for fraud or harassment, or for any commercial voice production.
• You must not clone the voice of a public figure, performer or any person whose voice is commercially exploited, without their express written permission.
• Cloned voices are for personal, non-commercial use within your own account.

You agree to indemnify us as set out in Section 16 against claims arising from a voice you cloned without proper consent. We may remove a cloned voice and suspend the feature or your account if we receive a credible complaint.

AI-generated speech is provided as-is and may not accurately reproduce any particular voice.

9. Sharing Cards

When you share a card you authorise the recipient to view it and to save their own copy. Share links expire, but a copy a recipient has already saved is theirs and will not disappear when you delete your original. Only share content you have the right to distribute, and only with people you intend to have it.

10. Reporting and Blocking

If someone shares a card with you that you find objectionable, tap Report on the card before you add it. Tell us what is wrong and we will review it within 24 hours, and remove content and suspend accounts where our review finds a breach of these Terms.

You can also block the person who shared it. A blocked person cannot share cards with you, and you can undo a block at any time from Settings → Blocked People.

Do not file reports you know to be false — misusing the reporting system is itself a breach of these Terms.

11. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or in violation of any applicable law.
• Upload content that infringes anyone’s intellectual property, privacy or publicity rights.
• Upload content that is harassing, abusive, defamatory, obscene, or that sexualises minors.
• Clone a voice without the consent required by Section 8.
• Attempt to access another user’s account or data.
• Reverse engineer, decompile or disassemble the app, except where that restriction is prohibited by law.
• Use the Service to distribute spam, malware or malicious content.
• Circumvent rate limits, storage limits or other usage restrictions, or use automated means to access the Service.
• Resell, sublicense or commercially exploit the Service.

12. Our Intellectual Property

The Service — its software, design, text, graphics, and the CardAgain name and logo — is owned by Triple Dynamic Solutions LLC and protected by copyright, trademark and other laws. We grant you a personal, revocable, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, in accordance with the App Store Terms of Service. Nothing in these Terms transfers ownership of anything to you. Your Content remains yours.

13. Deleting Your Account, and Termination by Us

You may delete your account at any time from Profile → Delete Account. Deletion is immediate and permanent: your cards, photographs, videos, voice recordings, voiceprints, calendar imports and profile are erased and cannot be recovered. Deleting your account does not cancel an App Store subscription — cancel that separately, as described in Section 6.

We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if your use poses a security risk to the Service or its users. Where circumstances allow, we will give you notice and an opportunity to fix the problem. If we terminate your account without cause, you may request a pro-rata refund of any prepaid subscription period through Apple.

Sections 7 (as to the licence for content already shared), 14, 15, 16, 17 and 18 survive termination.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that defects will be corrected.

CardAgain is not a backup service. Keep your own copies of anything you cannot afford to lose.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any non-waivable statutory rights you have as a consumer.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THAT PERIOD, OR (B) FIFTY US DOLLARS (US$50).

These limits do not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Triple Dynamic Solutions LLC and its members, officers and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of: (a) Your Content; (b) your use of the Service in breach of these Terms or of any law; (c) your infringement of anyone’s rights; or (d) your creation or use of a cloned voice without the consent required by Section 8. We will notify you of any such claim and you may control the defence, provided you do not settle in a way that imposes any obligation on us without our written consent.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing anything, please contact us at support@cardagain.me and give us 30 days to try to resolve the matter — most problems are solved this way.

If that does not work, you and we agree that the state and federal courts located in Cook County, Illinois have exclusive jurisdiction, and both of us consent to venue there. This does not prevent either of us from seeking injunctive relief in any court of competent jurisdiction, and it does not deprive you of the protection of mandatory consumer-protection laws of the country where you live, or of the right to bring proceedings in your local courts where that right cannot be waived.

18. Apple

You acknowledge that these Terms are between you and us only, not with Apple Inc., and that we alone are responsible for the app and its content.

• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and claims under consumer protection or similar legislation.
• Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Changes to These Terms

We may change these Terms. If a change is material, we will notify you in the app before it takes effect and update the date at the top. Continued use after the effective date means you accept the change. If you do not accept it, stop using the Service and delete your account; if you have an unused prepaid subscription period, you may request a refund from Apple.

20. General

If any provision of these Terms is held unenforceable, the rest remains in force and the unenforceable provision is modified to the minimum extent needed to make it enforceable. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.

21. Language

These Terms are written in English. Any translation is provided for convenience only, and the English version governs in the event of any inconsistency.
